signin24107-25 08:18 PMMy Labor has been approved around May 20 2007 and my employer got a letter from DOL stating the same (dated May 23), but my Lawyer says that they never got the Original Labor notice (may be they misplaced it).

Now I'm waiting to file my 140 and 485 together before Aug 17 and he says if we don't have the original Labor notice, we can still file 140 and 485 with the proof we have (DOL letter to the employer).

Will this work or will my 140 and 485 be denied ?? I'm not sure I can get my original Labor notice before Aug 17. Is there anyway to track with DOL ??

The speed in which h1 FOR MS in USA shows that there is not that much demand to H1s. Only around 7500 was filled. The H1 Cap 65000 was reached for because Indian companies were rushing to make it before H1 cap is reached. One has to analyse how much is going to be used really. They will use need basis and won't cancel if not used. So increasing to 110k will be enough to meet the real demand but then also Cap will be reached in another 2 months because consulting companies process h1 first and find the job for them later. But Real demand can be analysed in other way. Because of Rushing thro H1s lot of companies which are having Real job demand(Companies like Intel Microsoft) could not hire. H1s for US MS degree holders solved the issue Partialy. May be if the increase that quota to 40k then demand will be enough.

Meaning, if you apply for a H1B and a H4 later, if the H4 gets approved after her H1B, her status would automatically revert to a H4 because that was the last approved H application. If her H4 renewal is part of your H1B renewal, you could do yours as a permium processing application. That way, her H4 approval might come through well before her H1B approval.

To answer your last question, if you did not show a valid I-94 till Oct 2007 while applying for her H1B, her H1B approval would come through without a I-94 attached. If that happens, she will have to get her Visa stamped out of the country. Otherwise, she could potentially be without a valid I-94.


Will this be a problem?
I need answers to following questions.

1) Can i apply for mY wife's H4-B renewal while her H1-B application is pending?

2) What will happen, if here H1-B is approved after H4-B renewal is applied and before her Renewal of H4-B is approved?

3) What will happen, if my wife's H1-B is approved before H4-B renewal is applied. On what status will she stay untill Oct 2007. Does she have to go back to India and come back with a visa stamp?

Any other matrix?

Let me put it in a different way. Let us assume that DOS will end up using 90% of the VISA numbers during FY2008 (which means they will waste 10% which is an acceptable estimate). And to use these 90% numbers, they have to move the dates forward. As simple as that.

And all 2005 PD cases and most 2004 cases and few (or most) 2003 cases filed 485 between Jun-Aug 2007 which means those applications are not ready for approval yet and hence will not be a cause for retrogression.

Dates will and has to move forward this year. It may retrogress again once these 485 applications are processed and become ready for approval (consuming VISA numbers).

What is the duration of your EAD ? (I mean for 1 yr/2yr ?) and Is it effective from the date of approval or from the date on expiration of your current EAD ?. Hopefully, this is your last ead as GC should be on your way soon.

I opened a Service request for my case and got a reply last night, saying 'you cases is assigned an IO offices. Please allow us 60 days to make a decision ....'

I called the number on your I797 form and rep asked me, if I had any activity on my case in last 60 days. I said No so she opened a SR.
