While the USCIS numbers of pending I-485 make me relatively pessimistic on movement for India and China EB-2, the State Department�s internal case management staff are feeling more optimistic. In fact, we are seeing the National Visa Center issue fee bills for EB-2 India immigrant visa files with priority dates as late as November 2007, which would seem to indicate that NVC, at least, thinks the visa numbers will move at least that far ahead this year.
A caveat against reading too much into the NVC action: recall that it was imperfect information-sharing between USCIS and the State Department that led to the July 2007 �Visagate� debacle, and NVC likely has a small minority of the overall number of visa petitions with India and China EB priority dates in 2006 and early 2007, since so many of those beneficiaries could file for adjustment of status in July of 2007.
It�s also possible that NVC is simply trying to get cases set up with fees paid and documents submitted in case the numbers stay current for the rest of the fiscal year � but applicants would lose their filing fees if the numbers retrogress later this year.
We will have to wait for the May Visa Bulletin from the State Department, likely released by April 13 or so, for more detailed information on the State Department�s thinking.

I would not trust the lawyers in any of this, because their analysis will be superficial and not even close compared to what we see here. We have around 4-5 different folks here doing some really good sound analysis, so unless it's a lawyer known to historically make accurate predictions, I wouldn't care less about their say.

Please contribute to IV so that we can keep this effort going. While everybody is busy collecting documents and paperwork for 485, core IV again is doing there personal paperwork and + lobbying.
Please contribute, especially if you are new and never contributed. Please do not be a freeloader and get your questions answered and run away.
I hope people who posted on this thread and those whose question got answered consider contributing to IV. This was an important question confronting lot of people and lawyers were giving different and vague answers. All the information was researched and given to our members. Everyone was spending hundreds of dollars each asking lawyers this question. Contributing is a way to express your support for the community.

That being said I have no ill feelings towards people who used the opportunity to get their GCs faster, albeit by puttting in more of their money and/or working like slaves for a better life in the future (hopefully). EB3 to EB2 portability is someone trying to better his/her life after suffering in the queue forever and I have no issues with such people.
I, therefore, cannot support this case. BTW, I am an EB2-I with Sep. 2006 PD.

So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.
Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.
I cannot help but point out a flaw in your case: You say that your technical skills is a common one. Yet you don't seem to have an issue that you have applied in EB2 - exceptional ability / advanced degree. At this time, you are likely holding a H1B status - a speciality occupation visa. Something does not add up now, does it?.
However, I'm with you on wanting to stop L1 visa abuse (and H1 visa abuse as well). There needs to be a more definitive way of knowing L1 visa is being misused to replace US citizens and green-card workers.

We rode the same wave even last year with many of the same Guru;s predicting the same movement to 2007 and what we saw 2 weeks movement . There was one person called QSHEMK who after that went completely out of the picture or has rejoined with a new name .
Also I have analyzed that people who have a date in 2008 somehow predict that the dates might move to 2008 and people who have a PD of July predict that dates will move to August . This is just an observation and nothing more , and if you go through the threads thats exactly what you will see.
I will be equally benefited as you all will if the predictions come true , but be well prepared for a major heartbreak also like last year .
While it takes a lot of effort from some of the members to crunch such numbers I would be first to extend my sincere gratitude to them for doing this , I would also recommend you all to take the analysis and predictions with a grain of salt and not to raise your hopes too much on these predictions.
It has seldom worked for the last 6 years at least . Hope it does this time . I speak from experience in IV since 2006.

Double the number of annual Gc plus exclude dependents will be enough for reducing retrogession but that may not eliminate. But waiting period of 2 to 3 years can be reasonable for most people. I am sure one more chance will come for increasing H1b numbers. That time we can try for GC increase also.
But I am supporting the flower Campaign for protesting the VB mess up though it will not solve the problem

Most good companies do a thorough check which includes your credit history. When i joined the company i currently work , I asked for a copy of the report for my reference and it did include that i have a good credit history. Not sure how much companies pay attention to this but yes if they do it could affect your employment chances at some of the top companies.
On the positive side, I strongly believe that the economy will come back on track. Who knows 5-10 years from now your decision may look good. As others advised you should also consider renting out your place... With the population ever increasing, and the land being constant, I always think investment in land will always be a good investment on the long run. At least you have something concrete to show for your money :).
Rest the feeling that you are doing the right thing even though its the hard way is always priceless :)
Anyways i agree its easier to say these things sitting on the other side of the fence.

You can see the first application details in my signature. My second app's checks cleared the bank on 09/12/2007. This is the application that reached NSC on July 19th - the receipt is from TSC.

other security checks are OK and let the namecheck run in background . If the namecheck turns out critical , cancel the GC & deport the applicant.
But USCIS and lawyers will loose big time , because of reduced demand for APs,EADs etc.
