Lacris07-17 10:04 PMI understand the frustration. My husband has an Oct 2003 PD-EB2 ROW. His friend who applied in June 2003 in EB3 has a GC for 2 years already.When the backlogs were introduced in march 2005, the regional office was certifying cases one month older than his. I suggested to apply for PERM, but the lawyer said he'd lose the PD and it's not worth it-it will get certified soon anyway. That turned out to be January 2007. In march 2007 we finally applied for 140/485 and I was happy to notice cases in EB2-ROW were approved in as little as 2 months. My hopes were high, but not anymore.
I can't describe how happy I was for one of my friends that applied on July 2nd. I told her today's big news and she was in heaven.But at the same time I realized that it's not very good news for us. The delays will be now huge.
So people stuck in BECs, you have my sincerest sympathy. My thoughts will be with you and hopefully something can be done to help you.

checklaw09-19 01:37 PMThe IV bus journey from NJ was very well planned and executed. All I had to do as a "participant" was indeed to just hop on....no fine print! On the bus and at the rally made some wonderful friends.

singhsa3, mpada and everyone who may have worked on the NJ/NY bus logistics, you have been excellent! Thank you IV core for providing this convenience.

IV handle "laborchic" who was on our NJ bus co-coordinating the minute details of to and fro journey with help from another selfless soul "amit_sp”, superbly handled stopovers, timings, ensuring that we reached rally on time and also more importantly that 'No child (read registered bus member) was left behind' and keeping driver happy etc....

Special thoughts also go to whoever came up and arranged the idea of the Gurudwara stopover during the forward journey. It was simply superb! We were able to catch up some sleep there and were fresh for the rally. The host at the the Gurudwara was most gracious. The facilities were good. We were grateful for the lovely breakfast and tea that was served.

The rally was very well organized, right to the minutest details. It was a wonderful effort from some really tired but focused and determined looking volunteer folks whom I saw scrambling around while we participants had it easy. During the rally got a good view of the Capitol Hill and other spots. The cops on motorbikes, cars and bicycles monitoring our procession looked an awesome sight. But that paled compared to the feeling of camaraderie and friendship that was overwhelming all of us folks in white IV T shirts.

Also saw faces behind IV handles, the core and other ever active ones, and found out that they were just like me, two hands two legs.... no horns or feathers. Realization then struck that what probably differentiated them from a lot of us was simply that they have reacted to the same problems you and I have in a smart, constructive and selfless manner.

This is what I could remember and share with few of you who unfortunately could not make it and a whole lot of you who did not make it. To the latter, the feeling of high I have now from having acted upon my normal demons is something I am not able to describe. I just feel it......

I am taking courage to write to you after a long wait of 7-8years legally. I have been working since last 9 years for a Dallas based small company ( xxx Inc) with revenue of around $xxx a year. My skills contributed this company to stay in competition with billion dollar companies ( xxx,xxx,xxx). My wife in similar field is serving xxx ( xxx ), Fort worth.
We are highly skilled professionals from India, and have plans to contribute even more by establishing our own company and generate more income.
Since last 10 years I have been paying my taxes,ssn,medicare without fail.
Mine and my wife's Permanent residency process ( Green Card process ),EB3-India, is stuck since last 7.5years and with current pace it may take another 4years, a total of 11-12 years.
I am not sure about the relief through CIR.
During now thru CIR interim, I request you to instruct USCIS to apply the spill over of unused employment visas in the order of oldest priority date and not by the by category.
Right now, the spill over benefit is helping the applicants who applied 3years after me.
If 1) spill over order would have not changed 2years back and
2) 245(i) applicants would have not clubbed into existing quota,
my life would have been in order, and I would have not bothered you.
Please help,

485Mbe400104-08 07:02 PMSo now this thread has turned into a sob story of how a handful of misused EB1 visas are bad for the whole group (i am a screwed up low level EB3, i am not in competing with EB1's or 2 or 4's for that matter) ...we just need some bad guys to pin the blame on. We are loosing sight of the big picture here. We can either complain or cry or do nothing, to each his/her own. write a letter to the authorities. they will take 5 years to investigate and 10 more visas will be available to for redistribution to Eb2 from EB1, meanwhile we will create a new thread everymonth and complain how messed up the system is and how screwed up we are...:p.

...reminds me of a quote from Maya Angelou:
"If you don't like something, change it. If you can't change it, change your attitude. Don't complain."

Lets all get together and work for visa recapture, it is free of country and category caps, everyone will benefit.

tamil1207-14 03:35 PMLike it or not In legal language you become more so called bright in EB2. If you apply in EB1 you upgrade your so called brightness. It does not matter in reality who you are. But as far as law goes for EB1, EB2 and EB3 etc it prioritizes based on qualifications needed for performing the job function. Our employers and lawyers decide on those requirements. Have you questioned those requirements?

Maybe if we had questioned those requirements laid down by employer and lawyers, more people would be in EB2.

Don't say EB2 guys are brightest....I have seen many of my friends sitting on bench till now more than a year in body shopping company's getting greencards now........

I don�t know what is so hard about this deadlock. Don�t they know that if:
1. Illegals are given temporary visas for them to return after a number of years, no-body would come forward. The illegals would see this as shooting themselves in the foot. They would prefer to remain in the dark and live here permanently. Purpose defeated.

I am sure this is a reasonable middle ground�. a path to PR but not citizenship. I am sure those illegals don�t care about citizenship anyways. They just want to be free and be mobile.
