susie11-04 11:01 AMHaving spoken with several congressional aids I can say that such issues are well received. The specific issue that I have raised (it does not affect me) is examples of people leaving USA and having to explain to their US born children why mummy and daddy are not welcome in the USA, and thus why they have to grow up in a foreign country.

I have also given examples of one sibling being born in USA and other aging out.

However, I have only raised this where law makers are known to be sympathetic to family immigration, e.g. support DREAM.

I think that the best we can do is:
Get wait times down (and reduce impact of this).
Use this as an argument with those who support family based immigration (and may even be hostile to EB otherwise).
If we have an opportunity to address this as part of other EB legislation we can.

It is certainly not forgotten by me.

I do think that it would be helpful to have a list of people in IV with this problem (with ages of all children plus relevant dates). For the moment I'm too busy to organize this (busy with IV work -- like 4am bed times).

More active help (not just forum discussion) with IV is always welcome, so you are welcome to step up and help (e.g. compiling a list of such members etc.). Politics is personal so being able to present personal cases is helpful.

I guess chance for 1st and 2nd option are high. And, this would answer Ramba's question how EB3 for India would get approval for PD 2003. There are very few 2001 PDs left (per me). Relatively more 2002 and most of 2001 and 2002 are pending due to name check else they would have got their GC during July and USCIS would not have returned VISA numbers back to DOS nor some numbers would have finally got wasted (FY2007).

So next PD would be 2003 (and there are very few 2003 filings that were filed before June 2007).

And we are all subject to emotions and can make these mistakes as well where we forget to be civil.

It is frustrating in many ways....
My husband cannot switch job, even though better opportunities come his way!
There are travel probs to India as these days there r all sorts of cases happenning when u go for 'stamping' in India.
Also, I am a qualified & experienced professional (worked in a respectable MNC in India)....but cannot work. I did MBA from a university in PA thinking that it will help me launch myself in the job market when the EAD/GC comes.........but the 485 dates never came out of the spiralling mess.
U might think that I can go the H1B way.......but that itself is going in a bigger mess & employers r not willing to do in any more

So, when I saw this "Advocacy Day".....I thought its the time to get up & do something for ourselves as there might not be a second chance!!

How much longer would we have to wait?
Lawyer sent inquiry to DOL and they replied with a non responsive email saying the case status was Processing and they would be reviewed in a FIFO order. It does not seem to be a FIFO processing. People have filed at the beggining of the year and have been approved already. Also some audits approval from replies made on nov/dec 07.
What's going on?

satishku_200006-26 06:48 PMMost of the people on this forum know that USCIS can change the rules whenever they want. Most of the people on this forum also realise that the whole process of GC is a big blackhole in which surprises keep on coming.

As far as I am concerned my PD is Sep 2004 , If I get my GC in 4 more years I consider myself to be lucky.

Most of us dont have any control over the process and how things get executed at DOS and USCIS at the sametime all of the people cannot make sure that their applications reach USCIS on 1st of July .

So dont worry about the things that we dont have any control over ..

Relax and try to do things with a sense of urgency on which you have control ...

One said you should be able to travel on valid H4 (which I have) and be back in U.S before Oct 1st without any impact on COS.
Other one said i need to get H1 stamped in India (which I don�t want)
I don�t know whom to trust. :confused: If anybody has personal experience regarding this I would really appreciate if you can let me know.
I have to know early as I need to travel to India urgently.

jsb09-01 12:57 PMIf cases are preadjudicated and approval is just matter of of running script to identify probable applicants then we should see all(Based on number VISA availability) the Approvals today only.

But that seems not the case.

So what is their Process to handle Preadjudicated cases?

Approval is still a paper process. System data is entered with check marks on actions to be initiated, such as Send Approval Notice, Send Card Production Order notice, etc., while paper based aproval is underway. It is not a script running even with preadjudicated cases. There may be stacks of preadjudicate files, which are distributed to IOs, and, perhaps they still perform a last minute re-review before stamping "approved".

PD 3-15-05 RD 6-12-07
PD 10-21-04 RD 6-29-07

So they are past the June 8th date, looks like they are still processing pre PERM applications though.

PS pappu, I updated what I know exactly (PD RD of I 485), my lawyer has the rest.

They are definitely approving beyond June 8th but there are many people with RD's from May 07 and before and much older priority dates still waiting. Do not read too much into the approvals you see the approvals are somewhat random to say the least.

EB3 ROW, PD November 2002, RD May 2007. Still not approved. Getting impatient seeing people getting approvals with later priority dates and receipt dates. Think my application has got lost in a corner somewhere.

Yes, you will need to send the original passport along with the filled in application...Since the passport is expired for over an year, check this out:
