sdrblr09-02 09:43 AMI beg to differ from your point of view that approvals are on PD. If you take a good look at the PDs of approved cases posted here, you will there are many post July 04 (mostly in Oct and Dec 04) and we all know there are many before that.

They are clearly going by ND. I have seen 1/2 case approved that had ND after 8/30/07



High number of approvals over the first few days were expected. Centers review/preadjudicate cases based on 'real' receive dates (which are close to notice dates), as physical files are sorted in that sequence. That is happening. Sept VB was available couple of weeks ago, which prepared them to issue formal approvals as soon as September starts. USCIS SOP describes that once cases are preadjudicated they are shelved (wating for visa) in sequence of PD's. Therefore, most approvals are preadjudicated cases.

Congratulations to All who got approved. Best wishes to those still counting. If you ND is not too far from published dates (i.e. it is sometime in Aug/Sep/Oct 07), and your PD is high, there is very high chance of you getting a good news soon.

But the best way is to go to your home country and apply for a new H4, using your spouses H1 and paystubbs...I just have a friend who did this.....Having to transfer from h1 to h4 here in the usa may be risky, since USCIS will ask for paystubs, but back in india or your home country it will not be a problem.

Check with your lawyer too.

my application was forwarded to the phoenix lockbox. My checks were cashed from phoenix and then the application was sent to Texas. I recieved reciept notice dated april 16from Texas Service center and am waiting for the approval. I had read in some USCIS press release that if you send your application via usps then they will forward it to the correct center but if you send it via fedex or other courier service then they will return the application to you.

My lawyer received the following RFE during premium process of my PERM I-140 application.
===Here is the text from original RFE========
Submit evidence that alien obtained a true 4 years bachelor degree in Computer Science, Engineering, MIS, Math or Equivalent. Evidence of education must be in form of an official diploma, record/transcript showing all dates of attendance, area of concentration of study, and date of degree award, if any. The evidence submitted shows that the alien completed a three year Bachelor in Science Degree in India

fyi: I have 3 years of B.Sc and 2 Years of Post Graduate Diploma in MIS from India.

Let me know if anyone here has received thia kind of RFE and what could be the best next step to overcome this RFE.

There are certain rules that govern PR & Citizenship statuses ( of all countries)and only land mark & ground breaking edicts can alter such law�s , and that too very slightly. To put it were tersely "this is a bullshit suggestion" and is really wasting the purpose of this forum. The only reason so many people have responded is that it is "THAT RIDICULOUS"

That's a baseless comment. The law change of 5 yr req. after GC to 3 yr req. after GC for citizenship is procedurally same as any other law change including law change for increased visa numbers for GC. It is not like a change in constitution.

Which law change is easy or hard is an unknown. It depends on the current lawmakers and lobbies.

Having said that I agree EB GC issues are more pressing right now than to try and reduce citizenship wait times

dont worry the dates will move. Ask your attorney if he is willing to take a bet on that.
this year is "special". The July VB filings, the rush of approvals in teh last 2-3 months... lots of things have happened this year that have never happened in the past.

Congrats Masterji. BTW, how were you able to open the SR. I called them this morning and they told me that my PD became current yesterday so I should wait for 30 days before calling them back.



natrajs09-03 05:54 PMBy grace of Almighty, finally my Inbox received the email from USCIS that I was eagerly waiting for.

Just few minutes back, I received the Email from USCIS for myself, my wife and daughter saying "Current Status: Notice mailed welcoming the new permanent resident".

It's a long journey started in August 1997 with landing in Washington Dulles Airport. Got a chance to start the GC process by filing Labor in 2001. The labor approval didn't come until 2007.

In 2004 had to take a transfer to different company which caused me to start the Labor again in Nov 2004. Lost the valuable 3 years of PD date.

Finally the approval for 2nd labor came just right before 2007 July Fiasco. Luckily I had my attorney filed my application on July 2nd itself. And Rest you know the story.

All throughout I was on H1B, on permanent employment and never out of status. Never had any problem with Immigration process except for the GC delay. In any way it was an interesting journey, making new friends, had the chance to live in SFO, LA, New Jersey, Virginia and currently in Maryland.

Many thanks to IV and its members for providing the wonderful platform for sharing and collaborating for common cause.

10 years and still waiting

My case is also similar to yours, My 1st labor was filed 2001 March, and I had to switch my employer and the 2nd labor was Sept 2002, Again I had to switch the employer, And finally 3rd labor was filed on June 2004, cleared around Dec 06 from the BEC .

Still waiting for GC with the Valid H1 ( Until Feb 2011)

I am waiting for the magic email.
