Is there a way to check your PERM status online using the receipt number? I tried researching it but did not find anything.

Only your lawyer or company can check it ...Labor is for company and not you.... so they have a right to check it.

sanju04-09 10:33 PMI think current mad rush is because of following reasons.

1) Atlease 35K new H1s filed because of H4-H1 conversions. This is because of retrogression and H4s waited longtime to work and so they are desparate to work. We can eliminate this if we have I-485 filing provision without visa number availability provision of STRIVE act. These people deserve it until there no solutuon to Retrogression.

2) 70K visas are filed by Offshoring/Outsouring firms firms. This is where the actual problem is. They won't send all of them whom they file. They will unnecessarily waste all these H1s after getting approvals. I know so many visas are wasted by Satyem, Wipro, TCS, Infosys, Accenture and all other offershoring/outsourcing firms every year.

3) 15K-20K by US educated students. These are deserved to file.

4) 10K - New H1s for real projects needed by clients. These are also deserve to file for H1.

So, here the problem is Offshoring/Outsourcing firms who are abusing the law by filing and not sending all of them. I can definitely say 85% visas filed by these firms every year are wasted and they won't send all these employees whom they file. They are using this H1 as seat reservation in a bus/train. They only send very few and waste so many visas every year. In all these firms, i know so many employees are having H1 stamped and waiting to come here. But those companies selects very few and send them here. If at all we need any reform in H1B, then it is here by not allowing H1s from these Offshoring/Outsourcing firms. Then everybody will be happy. These firms can use only L1 for their company needs so that H1 won't be abused.

Also, first point, we can solve by passing the curent version of STRIVE.

So, we need to oppose this new H1B reform and make to sure that Congress passes STRIVE act provisions.

Any thoughts from my friends?

Let me guess. You have a friend or a relative in the H1 que. And this H1 applicant is either getting education in US or is not going to be an employee of a consulting firm.

Second guess: You have a US degree or you are not working for a conslting firm.

Why do you think the spouses on H4 do no deserve H1? If they want to work, why do you think that they should not compete in the job market?

BTW, the companies you are cursing, TCS, Wipro, Satyam etc., it is possible that soon the H1s applied by these companies will be exempt from numercial limit. Yes, you heard me right. Here is a bill that would make companies providing scholarships to undergrad and grad programs to be exempt from H1 numerical count. This is not a joke, read for yourself: :p

Expedite request denied, have an infopass appointment on August 14th. I will see what they will say
Getting too worried as my current ead is going to expire on Sep 19th.
Looking at the tracking it looks like TSC has started to work on all these pending cases. Hopefully our petitions get approved soon too

Just happen to see your signature file and found that you have a RD around end of June 2007 at TSC. I think we can use it as data reference to say TSC processing time will go to at least end of June 2007, from 04/30/2007. That is probably a good news for whose files in TSC.

I am just wondering do they assign it to officer when dates are not current ?

arihant05-17 12:34 PMThey will still do all the work needed to approve your application even when it is retrogressed. But, they just will not issue the actual Green Card until the dates go past your PD again.

You can remain on H1 until such time or use ur EAD and renew it on a yearly basis. The choice is yours based on your circumstance.

i arrived saturday morning and went through a comedy of errors before reaching the comfort inn that many of us were to stay...was hungry and tired and wondering where everyone was...and then nixstor turns up with the very best home cooked food possible....aman arrived too and after a mad scramble to arrange plates we all consumed it like we had never eaten before...memories of that meal are making me hungry again...:D

amirani05-16 05:48 PMI had discussion with Mr.Gotcher about this issue. He said, AILA is collecting information on this matter and they are pursuing with Altanta center. But he does not believe or expect any positive outcome. As said earlier he insist to send a formal complaint with OIG and offered his time/help. As its affecting large group of people he refused to accept any fee. I offered we are ready to cover any expense which he might incurr, but seems like it would be very less and he offered free service. Mr.Gotcher will draft a letter in a week time. What we need now - lot support and signature. We do not need to provide any case number. so I dont believe there would be any consequence. So guys please come forward. Spread this news as much as possible and get enough support. Help yourself and get out of this mess.

We have spurned job offers and declined the new PERM process to hold on to the priority dates.

Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.

People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.

Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

* EB2 (India/China) may not have MANY cases with PD earlier than 2005 as only after retrogression (in 2005), EB2 started piling up.

* Most 2001/2002 EB3 cases are approved (in June/July/August 2007) and they may be still receiving approvals off numbers reserved for them in June/July 2007. Hence, the natural movement for EB3 to 2003 in the near future.

* If most of the EB3 cases filed in June/Juy are not processed by USCIS by next June (2008), then PD may become current during the last quarter of FY 2008 (or atleast to end of 2006). If enough cases are approved (and pending for VISA numbers), then it may move only to 2004 or early 2005.

* EB2 - same logic as above - it may become current or move to early 2006.

Makes sense?
