They will be forced to hire citizens/GC holders with H1bs if this bill is passed in same form. USCIS will take care of small Indian bodyshoppers by RFE and asking client letters etc if they start multiple companies. Of course there will be loopholes our Indian companies will find in any law but still it will clean up H1b and L1 atleast for some extent.

On another note - consulting companies will workaround by creating multiple companies and applying h1b through various companies

qvadis08-21 05:12 PMIn my opinion it is very naive to think that USCIS/DOL just realized that they had 'misinterpreted' the law. They had made it very clear how they allocated 'available' visa numbers after AC-21 was introduced, and I am sure they consulted with the law-makers.

It's almost funny to read that they consulted with today congress. How would they now of the intentions of the congress in 2000?

According to Ron's post, 70% are from India and China, and Mexico is also reaching the ceiling. They realized that the only way to shift those numbers is to give more visas to India and China. The ambiguity of the law for the preference of vertical vs. horizontal spill-over allowed them to do that.

If your PD is 2003, then you are waiting for 5 years, not for decade. Just FYI, saying decade (instead of 5 years) is material misrepresentation.

indianindian200610-05 04:23 PMSeems like there might be an internal memo or understanding between USCIS and DOS not to approve many Eb2 India 485 even though there dates are current, this is the only explanation I can come up for the lack for eb2 india approvals in October. Even with the limited number of visas every quarter I was hoping there would be lot of approvals because of Visa spillover occuring every quarter instead of once every year, but looking at the USCIS performance in the first week of october it seems like there wont be any quarterly spillover at all.

Correct me if I am wrong but to my knowledge quaterly spill overs if any would be in the last month of the quater which should be in Dec 2009

addsf34508-20 06:21 PMFYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

I have similar experience. I moved to sunrocket (which is now teleblend) from vonage. I pay half of what I used to pay vonage for same services/usage.

currently teleblend offers $50 unlimited india calling + ofcourse US+canada unlimited. However as now vonage has come up with $25 world plan, I am sure teleblend would come up with something similar soon... may be $20 world plan or so. As they always price it below vonage. Let's hope! competition is good for consumer.

b) Lying on the resume with "skills" that you don't have, so that you can learn the "skill" at the expense of the client
c) "Skill" in Violating B1 visa laws and sending people on B1 to do actual work to client
d) "Skill" in violating L1 law which is used to drive down the wages by 20-30%
e) "Skill" demonstrated by indian offshorers to enter into a contract with a large corporation where they will provide warm bodies in exchange for a very low billing rate. Client wouldn't have any ability to interview the incoming cosultant, which means the offshorer employee is learning at the expense of the foolish client. Then that will be touted as "savings".
f) "Skill" of fly-by-night operators to shave off 70% of the billing rate through a 6-level pyramid of contracting companies

Should I add to this list of "skills" further?

Got RFE (sept 10, 2010). was working on RFE (medical report needed)..

Today I spent around $300 to start medical exam report. I've to still to do lab work and may need x-ray. I was working with my swollen arm and got this message..

01. Why in Form I-693 medical examiner submitted x-ray but no skin test (we did it because we had the TB vaccination in childhood and skin test would come positive and we had to take x-ray anyway) ---Not an Issue, we can answer that

02. Submit current dated EVL for your new employer. No issue. we can answer that

For my wife also asking for 2 evidences:

01. About the same medical issue.
02. Provide her non-immigrant status between Feb 2003 to Jan 2004.

I don't know what do. Looks like we are doomed. My wife came here with H4 in 2000, was provided I-94 from the airport for 3 years (till Jan 2003), we didn't know then that we have to file a I-539 extension for H4 extension (even couple of my friends had the same idea). We knew that as long as I am on H1, she would maintain H4. I came to know in Jan 2004 and then we applied for I-539. I know this is stupid but that what happened. Anybody has any experience please reply..please please. We are really sleepless this time.

You can not change what had happened. They already found it.

And you did not do that in purpose and the dependant did not take any advantage during that period. So get a good lawyer and give proper explanation. Being out of status does not disqualify the application immediately. It depends on the explanation and the reviewer. There may be exceptions.

On top of that these smart asses think they are answerable to none - since this is just a matter of 'to be' immigrants.

Now the class action suit proposed by AILF will surely shock them from their oblivion and bring them down to REAL world.

I agree we might not always have hard evidence unlike the OP here. And lot of employers might be doing this. I have never faced this, yet. However, we have to act on it. The first step is to complain to the govt. Maybe if there are lot of complaints, govt will investigate and find the dirt, and fix it.

Another idea is to bring it to the attention of the job boards that discriminatory ads should not be posted. Lets give this a try.

To those effected, write to the govt if you are in a situation where you can.
